Our store is hosted on an e-commerce platform provider that enables us to sell our products and services to you.

You understand that your content (not including credit card information) may be transferred unencrypted and may involve: (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks through our payment processor.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service without our express written permission.

We reserve the right to:

We do not guarantee that all products described on the Site will be available. We may limit quantities purchased per person, per household, or per order, and may limit or refuse any order that appears to be placed by dealers, resellers, or distributors.

5. Pricing, Taxes, and Payment

All prices on the Site are listed in U.S. dollars unless stated otherwise and do not include applicable taxes, shipping charges, or optional service fees, which will be calculated and displayed at checkout.

Payment is due at the time you place your order. Payments are processed through third-party payment processors. By submitting payment information, you authorize Hudson Sutler and its payment processors to charge your selected payment method for the total order amount, including applicable taxes, shipping, and any optional fees disclosed at checkout.

Hudson Sutler reserves the right to cancel or refuse any order or transaction in the event of suspected fraud, unauthorized activity, pricing errors, or other violations of these Terms. If a transaction is cancelled after payment has been captured, we will issue a full refund for the affected amount.

Pricing Errors: If Hudson Sutler discovers an error in the price of a product you have ordered, we will contact you to inform you of the error and give you the option of confirming your order at the correct price or canceling your order. If we cannot reach you using the information you provided, we will treat the order as canceled. If your order is canceled and you have already paid, we will issue a full refund to your original payment method.

Promotional Codes and Discounts: Promotional codes and discount offers are subject to specific terms communicated at the time of the offer. Unless otherwise stated:

• Only one promotional code may be used per transaction.

• Promotional codes cannot be combined with other offers or discounts.

• Promotional codes may exclude certain products (sale items, gift cards, custom or personalized orders).

• Hudson Sutler reserves the right to modify or cancel promotional offers at any time.

6. Orders and Acceptance

Your order is an offer to purchase products from Hudson Sutler. Order confirmation emails acknowledge receipt of your order but do not constitute acceptance. Acceptance occurs, and a contract for sale is formed, when we process and ship your order.

We reserve the right to refuse or cancel any order prior to acceptance, even if payment has been processed, in which case we will issue a full refund.

Shipping, delivery timing, carrier methods, processing windows, personalized item lead times, free shipping thresholds, shipping destinations, carrier delays, and lost or stolen package handling are described in our Shipping & Delivery Policy, which forms part of these Terms.

7. Risk of Loss

Risk of loss and title pass to you upon our delivery of the order to the carrier, except where otherwise required by law. Hudson Sutler arranges shipping through reputable carriers but is not responsible for carrier delays, damages, or losses once the product has been transferred to the carrier.

8. Custom and Personalized Orders; Lead Times

Certain products, including personalized and embroidered items, may be made-to-order or subject to extended production times due to artisanal production methods.

• Custom and personalized orders may require deposits and are subject to our Returns & Refunds Policy.

• Estimated production and delivery timelines are estimates only, not guaranteed dates.

• Lead times are subject to change due to supplier delays, material availability, and shipping disruptions.

• Orders are not confirmed until you receive an order confirmation email from Hudson Sutler.

9. Returns, Refunds, Final Sale Items, and Gift Cards

Our Returns & Refunds Policy governs return windows and eligibility requirements, final sale categories (including personalized or embroidered items, custom orders, sale and final-sale-designated items, gift cards, and items damaged through wear and tear or misuse), golf bag restocking fees, and return shipping options.

Please review the Returns & Refunds Policy prior to purchase so you understand which items are eligible for return and under what conditions.

10. Gift Cards

Hudson Sutler gift cards may be offered in physical or electronic form. Gift cards:

• Are redeemable only for eligible purchases on the Site.

• Are not reloadable, have no cash value, and cannot be redeemed for cash except where required by applicable law.

• Are final sale and non-refundable, except as required by applicable law.

Several states require that gift cards with a remaining balance below a specified threshold (typically $5–$10) be redeemable for cash upon request. If you are a resident of such a state, your statutory rights are unaffected by these Terms. Please contact support@hudsonsutler.com for assistance.

Hudson Sutler is not responsible for lost, stolen, damaged, or unauthorized use of any gift card.

11. Account Security

If you create an account on the Site:

• You are responsible for maintaining the confidentiality of your username and password.

• You are responsible for all activities that occur under your account.

• You may not share your account credentials with any third party.

• You must notify us immediately at support@hudsonsutler.com of any unauthorized use of your account or any security breach.

• Hudson Sutler reserves the right to suspend or disable any account at any time if we believe you have violated these Terms or for security and maintenance reasons.

12. Accuracy, Completeness, and Timeliness of Information

We are under no obligation to maintain any User Content in confidence or to pay compensation for any User Content.

You may request removal of your User Content by contacting us at support@hudsonsutler.com, and Hudson Sutler will make commercially reasonable efforts to remove it, except where the content has already been incorporated into marketing materials or is required to be retained by law.

Hudson Sutler reserves the right, but not the obligation, to remove or decline to use any User Content for any lawful reason.

To the fullest extent permitted by law, Hudson Sutler’s total liability for any claim arising out of or relating to the Site, the Services, or any product will not exceed the amount you actually paid to Hudson Sutler for the product or transaction giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you to the extent prohibited by law. Notwithstanding the foregoing, nothing in these Terms limits any rights you may have under the consumer protection laws of your state of residence that cannot be waived by contract.

You agree to defend, indemnify, and hold harmless Hudson Sutler and its affiliates, officers, directors, employees, agents, service providers, and suppliers from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to: your use or misuse of the Site or Services; your violation of these Terms or any applicable law; your infringement of any third-party right, including intellectual property or privacy rights; or any User Content you submit or make available.

Hudson Sutler reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense.

By using the Site or Services, you consent to receive communications from Hudson Sutler electronically, including notices, disclosures, agreements, order confirmations, and other communications. You agree that all such electronic communications satisfy any legal requirement that such communications be in writing.

25. Governing Law

These Terms and any disputes arising out of or related to the Site, the Services, or any purchase from Hudson Sutler will be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law rules. Notwithstanding the foregoing, nothing in these Terms limits any rights you may have under the consumer protection laws of your state of residence that cannot be waived by contract.

26. Dispute Resolution and Arbitration

Before initiating any formal dispute, you agree to contact Hudson Sutler at support@hudsonsutler.com to attempt to resolve the issue informally.

If the dispute cannot be resolved informally, any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Site, or any products purchased through the Site shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall take place in New Jersey.

Notwithstanding the foregoing, either party may bring an individual claim in small claims court where jurisdiction and amount in controversy permit.

You agree that any arbitration shall be conducted on an individual basis and not as a class, collective, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration. By entering into these Terms, you are waiving the right to a trial by jury. This arbitration provision applies to all disputes arising out of or relating to these Terms, any incorporated policies, and any executed transaction-specific waivers or acknowledgments.

27. Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the unenforceable portion will be deemed severed from these Terms. Such determination will not affect the validity and enforceability of the remaining provisions.

28. Entire Agreement

These Terms, together with the policies and documents expressly incorporated by reference, constitute the entire agreement between you and Hudson Sutler regarding your use of the Site and Services, and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written. Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

29. No Waiver

Hudson Sutler’s failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision. Any waiver will be effective only if in writing and signed by an authorized representative of Hudson Sutler.

30. Assignment

You may not assign, transfer, or delegate any of your rights or obligations under these Terms without Hudson Sutler’s prior written consent. Hudson Sutler may assign, transfer, or delegate its rights and obligations under these Terms, including in connection with a merger, sale of assets, or change of control, without notice or consent to the extent permitted by law.

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting changes to our website.
